Terms of Service

Welcome to 3marty. These Terms of Service ("Terms") govern your use of the 3marty mobile application and related services (the "Service"), operated by Abdelrahman Yehia Ibrahim Mahmoud ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What 3marty is

3marty is a tool that helps building owners issue invoices to their residents and helps residents view and settle those invoices. 3marty records payments that users make to each other through the methods the owner accepts (InstaPay, Vodafone Cash, Etisalat Cash, or cash).

3marty is not a bank, payment processor, escrow, or money-transfer service. We are not a party to any rental, ownership, or payment agreement between owners and residents, and we never hold or move your money.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the Service.

3. Your account

You are responsible for the information you provide, for keeping your password confidential, and for all activity under your account. Tell us promptly if you suspect unauthorized use.

4. Owner subscription & fees

Building owners pay a subscription to use the owner tools in 3marty. The subscription is currently EGP 199 per month, purchased through Google Play in the app.

Residents use 3marty free of charge. The owner subscription is for access to the Service only and is separate from any building dues a resident pays to their owner. We may change fees or introduce new plans by giving reasonable notice; continued use after a change means you accept it. Except where required by law, fees already paid are non-refundable.

5. Payments between owners and residents

Residents pay building dues directly to their owner through the methods the owner accepts (InstaPay, Vodafone Cash, Etisalat Cash, or cash). 3marty only records these payments and helps the owner verify or correct the amount received. We do not process or hold these funds and are not responsible for the underlying transfer or any dispute about it. Owners are responsible for the accuracy of the invoices they issue and the amounts they confirm.

6. Acceptable use

You agree not to misuse the Service: no unlawful, fraudulent, or abusive activity; no uploading of other people’s data without a lawful basis; no attempts to break, overload, or reverse-engineer the Service; and no use that infringes the rights of others.

7. Your content

You keep ownership of the content you add (such as invoices, complaints, comments, and payment screenshots). You grant us a limited license to store and display that content as needed to operate the Service. You are responsible for what you upload and confirm you have the right to share it.

8. Availability

The Service is provided "as is" and "as available". We may change, suspend, or discontinue features, and we do not guarantee that the Service will be uninterrupted or error-free.

9. Disclaimers & liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, for lost data or profits, or for disputes between owners and residents. Our total liability for any claim is limited to the subscription fees you paid to us in the three months before the claim.

10. Suspension & termination

We may suspend or terminate access if you breach these Terms or use the Service unlawfully. You may stop using the Service and delete your account at any time (see the Privacy Policy for how deletion works).

11. Changes to these Terms

We may update these Terms from time to time. We will update the "last updated" date, and significant changes will be communicated in the app. Continued use after an update means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute will be subject to the competent courts of Cairo, Egypt.
